At what point do the Club consider that they may become vulnerable to a restraint of trade or loss of earnings claim being brought by their employee ?

If it went to Crown Court then a judge threw it out for lack of evidence then could the club sue the CPS? Probably wouldn't have a leg to stand on though because technically he could have continued to play.
